What Really Happens During a CBP Detention

When U.S. Customs and Border Protection (CBP) detains a shipment, it can cause immediate concern for any business relying on timely delivery of goods. Understanding how the detention process works can help companies respond more effectively. In most cases, the process begins before the shipment ever reaches the port. CBP uses advance data and risk-based targeting to identify shipments that may require closer examination. Factors such as the shipper, consignee, product description, country of origin, or past violations can trigger a shipment to be flagged for inspection. If something appears suspicious or inconsistent, CBP may detain the goods to gather more information. The importer will receive a Notice of Detention explaining that the merchandise is being held pending further review.


The importer is given a limited window of time, typically thirty (30) days, to resolve the issue. If nothing is done during this period, the detention may convert into a seizure. Many businesses assume that CBP will continue to request information or wait for the importer to respond, but once the thirty-day period expires, CBP is authorized to move the case forward without further input. This is why prompt action during the detention stage is critical.
