International trade agreements, such as the United States-Mexico-Canada Agreement (USMCA) and the World Trade Organization (WTO) agreements, come with specific rules of origin that determine whether a product qualifies for preferential treatment under the agreement. For importers and exporters, understanding these rules is essential for minimizing tariffs and ensuring compliance with trade regulations.

Rules of origin specify the criteria that must be met for a product to be considered as originating from a particular country. These criteria often involve the percentage of the product’s materials that come from the country or the extent of the product’s transformation in that country. To comply with rules of origin, businesses must maintain detailed records of the production process, including where materials are sourced and where the product undergoes assembly or other transformative steps. Proper documentation is important, as U.S. Customs may request proof that a product meets the origin criteria. Failure to comply with these rules can result in additional duties or penalties, undermining the benefits of the trade agreement.

It is also important for businesses to stay up to date on changes to trade agreements and rules of origin. For instance, the shift from NAFTA to USMCA brought significant changes to the rules, especially in industries like automotive manufacturing. By keeping informed and maintaining compliance, businesses can optimize their supply chains and take full advantage of the preferential terms offered by trade agreements.
