FDA Issues Warning Letters for Unauthorized Youth-Appealing E-Cigarette Products: What Retailers Need to Know



The U.S. Food and Drug Administration (FDA) recently issued warning letters to seven online retailers for selling unauthorized e-cigarette products. These products, marketed under various brand names including Elf Bar, EB Design, Bang, Cali Bars, and Lava, were found to be particularly appealing to youth, which raised concerns about their widespread use among this demographic.


Youth Appeal and Surveillance


FDA's decision to issue warning letters was informed by ongoing monitoring of multiple surveillance systems designed to identify products that are popular among youth or have youth appeal. Recent findings from the 2023 National Youth Tobacco Survey highlighted that over half of current youth e-cigarette users reported using Elf Bar, prompting targeted enforcement action from FDA. Similarly, brands like Bang, Cali Bars, and Lava were flagged as popular or youth-appealing through a comprehensive review of retail sales data and data from a survey of youth.


FDA's Response


Brian King, Ph.D., M.P.H., director of FDA’s Center for Tobacco Products, emphasized the agency's commitment to protecting public health by identifying and addressing youth-appealing products. FDA will continue to closely monitor compliance and take enforcement action against those who sell unauthorized e-cigarettes designed to encourage youth use.


Legal Ramifications for Retailers


Retailers found selling or distributing unauthorized e-cigarette products face legal consequences under the Federal Food, Drug, and Cosmetic (FD&C) Act. Warning letter recipients are given a 15-day window to respond with corrective actions to prevent future violations. Failure to comply may result in further FDA actions, including injunctions, seizures, and civil penalties. FDA's enforcement efforts extend to all levels of the supply chain, with a particular focus on retailers to ensure compliance with the law.
