The country of origin is typically where the product was manufactured or substantially transformed. A "substantial transformation" occurs when a product undergoes a significant change in form, appearance, or use that creates a new and distinct article. For example, assembling parts from multiple countries into a final product may qualify as substantial transformation in the country where the assembly occurs, making it the country of origin.


To determine the correct country of origin, importers should thoroughly review the manufacturing process and supply chain. Detailed documentation, such as production records and shipping documents, can help confirm the origin of goods. It’s also important to be aware of any preferential trade agreements that may affect the duty rate based on the country of origin, such as the United States-Mexico-Canada Agreement (USMCA).


In cases where the origin is unclear, importers can request a binding ruling from CBP. This ensures that the determination is legally valid and can help businesses avoid costly errors in their import declarations. By ensuring that country of origin determinations are accurate, importers can avoid potential violations and penalties while benefiting from the proper application of duties and tariffs.
