When U.S. Customs and Border Protection (CBP) seizes currency, individuals are often left facing a complicated administrative process with significant financial consequences. Our firm recently assisted a client in successfully recovering seized funds after CBP initiated a forfeiture action involving alleged currency reporting violations.


Understanding Currency Reporting Requirements


Federal law requires travelers transporting more than $10,000 in currency or monetary instruments into or out of the United States to file a report with the government. Failure to comply with these reporting requirements can result in the seizure of funds and the initiation of forfeiture proceedings.


While currency reporting violations can lead to serious enforcement actions, a seizure does not necessarily mean that the funds will be permanently forfeited. Individuals may have legal defenses available and may be able to demonstrate that the funds were lawfully obtained and intended for legitimate purposes.


Client's Story


Our client faced the seizure of a substantial amount of currency by CBP during international travel. Following the seizure, the client retained our firm to assist with responding to the forfeiture action and presenting evidence regarding the source and intended use of the funds.


Working closely with the client, our team gathered supporting documentation and prepared a comprehensive submission addressing the government's concerns. Through the administrative petition process, we were able to demonstrate that the funds were derived from legitimate sources and that significant mitigating factors warranted relief.


As a result of these efforts, CBP granted relief and authorized the return of the vast majority of the seized funds, subject only to a minimal administrative penalty.
