Many people believe they can purchase a counterfeit watch online for personal use without consequence. However, this is not true. Unfortunately sellers of counterfeit goods will often try to reassure unsuspecting buyers into making a purchase without understanding the potential consequences. Buying counterfeit goods is illegal, even if you never intend to resell them. This misconception often leads to unpleasant surprises when U.S. Customs and Border Protection (CBP) intercepts and seizes counterfeit shipments at the border.
Losing your purchased item is not the only problem. After a seizure, CBP may issue a penalty that’s typically calculated based on the manufacturer’s suggested retail price (MSRP) of the item if it were genuine. Hence, the resulting fine can far exceed the amount paid for the counterfeit watch, or any other counterfeit item. For a more detailed explanation of how these penalties work, you can refer to our blog on CBP penalties.
In addition to CBP penalties, individuals may also face civil liabilities. The companies whose trademarks have been infringed have the right to pursue civil lawsuits, which can lead to significant financial consequences. Moreover, CBP may notify other federal agencies of the violation.
Another risk many buyers overlook involves Trusted Traveler Programs, such as Global Entry, which allow for expedited processing through security for pre-approved, low-risk travelers. However, CBP may revoke your eligibility or status for these programs if they determine that you violated regulations by importing counterfeit goods.
CBP takes counterfeit goods extremely seriously because they pose multiple threats to the nation’s economy, security, and consumers. These products undermine innovation and competitiveness, undercutting legitimate businesses and threatening the livelihoods of workers. In some cases, these fake goods endanger public health and safety when they contain harmful or banned materials. Beyond economic harm, counterfeit trade is often linked to criminal activity, supporting illegal labor practices and organized crime.
CPB’s mission to protect intellectual property (IP) rights ensures that businesses can compete fairly and that creativity and innovation continue to thrive. By working closely with IP rights holders to safeguard their brands, CBP supports honest businesses and helps maintain a fair and secure marketplace that benefits both producers and consumers alike.
