Why does my tobacco and/or vape retail company need a Tobacco Products Retailer Training Program?
In order to combat an increase in youth vaping due to the attractiveness of flavored e-liquids, the U.S. Food and Drug Administration (FDA) has announced its intention to change its 2017 compliance policy and enforcement priorities against electronic nicotine delivery systems (ENDS). Under this new policy, the FDA intends to focus on products considered “new tobacco products,” or products new to the marketplace as of February 15, 2007. Additionally, due to the nature of the increase in youth vaping, the FDA intends to focus new enforcement priorities on product flavors which are other than the traditional tobacco, mint, and menthol.
E-liquids, e-cigarettes, cartridges, tanks, mods, etc. are all considered “new tobacco products,” and as such, tobacco and vape retailers need to both stay abreast of, and comply with, any and all developments in order to continue their lawful operation.
The “D-I-Y Tobacco/ Vape Retailer Training Program” is an Eventbrite webinar hosted by Deanna Clark-Esposito, Esq. of Clark-Esposito Law Firm, P.C.—a law firm that specializes in helping vape and tobacco industry retailers and manufacturers make sense of, and comply with, FDA and TTB laws, filings, and disclosures so that they can operate lawfully—that is specific to vape industry retailers of products (including e-cigarettes. e-liquids, ENDS generally, and their components, parts and accessories).
The FDA recognizes the importance of retailers in the effort to reduce the occurrence of underage vaping, and this webinar is designed to provide vape industry retailers with appropriate protocols for training its staff and managers. These protocols will allow retailers to incorporate the FDA legal framework into their day-to-day business operations, as well as meet their FDA compliance obligations as retailers of these products.
A Tobacco Products Retailer Training Program includes the creation of a manual that delineates the necessary actions vape and/or tobacco retailers must take to ensure their lawful operation and avoid penalties. The purpose of implementing a Tobacco Products Retailer Training Program is to ensure that management and staff understand what protocols they must follow in order to abide by FDA laws.
Attendees of this webinar will learn about recommended training processes, restrictions on sales of products, best practices for hiring and management, penalties for violations of the Tobacco Control Act, guidelines for advertising and promotion, and managing FDA communications. Additionally, all ticket holders will receive a copy of an In-Store Incident Report Form for use at retail location(s), as well as a complimentary 30-minute telephone consultation with Deanna Clark-Esposito, Esq.
The “D-I-Y Tobacco/Vape Retailer Training Program” Eventbrite webinar will be offered from 1:15-2 PM EST on the following dates: 5/8 and 6/5. Please click the link below for more details.
